Abstract

Crimes of sexual abuse against children are regulated in Article 76 of Law Number35 of 2014 concerning Child Protection. Child abuse is one of the social problems that arevery disturbing to the community so that it needs to be prevented and overcome. Thecriminal act of sexual abuse that occurred in the jurisdiction of Polres Bukittinggi for thelast 3 (three years) has increased, so it is interesting to study from the criminology aspectby looking for the causal factors, so that efforts can be sought or solutions to overcomethem. The rise of sexual abuse that occurs can be caused by weak self-control and a weakpsychological condition of a person, but also because of technological factors such aswatching pornographic films that make the perpetrators unable to resist themselves andeconomic factors and factors of low education.

Abstract

The provision of remission for corruptors becomes an interesting issue to bediscussed with the issuance of Government Regulation No. 99 of 2012 whose substance isjudged to be contrary to the penal code. The Government Regulation contains severaladditional requirements for special criminal inmates. For prisoners of corruption, thereare two requirements that must be met, namely the general terms and the specialconditions that are applied cumulatively if you want to get a reduction in the period ofdetention. This condition resulted in the increasingly difficult inmates of corruption toobtain remission as happened in Penitentiary Class IIA Padang.

Abstract

The reformation form of the imprisonment system established by the government is Law No. 12/1995 on Penalization. In the community system, the rights are given to human rights and the exercise of human rights, remission is the right of all prisoners of special crime is not easy to obtain such remission because it is contained in Article 34 A paragraph (1) because it is related to Government Regulation No. 99 of 2012 which determines the prerequisites to be met by the inmate can be said to be a constraint in the remission of the perpetrators of special criminal acts.This research is analytical descriptive with approach method used is normative juridical as main approach and supported by empirical juridical approach. Sources of data used are secondary data and primary data. The data obtained were analyzed qualitatively and presented analytically descriptively. Based on the discussion and analysis it can be concluded that the first obstacles encountered in the provision of remission to special prisoners of crime based on Government Regulation No. 99 of 2012 is the provision of remissions to convicts of special criminal offenses based on the discussion and analysis of the writer can be said not effective because the implementation of remission to convicts a special crime in Class II A Correctional Institution in Padang City is carried out in accordance with Article 34 of Government Regulation Number 99 of 2012 and 34 A Paragraph 1 of Regulation No. 99 of 2012 in addition to the process and procedure of granting remission is based on Regulation of Minister of Law and Ham Number 21 year 2013 on the procedure of giving Remission Asi milasi, Leave visiting family, Parole, Leave free, and Conditional leave. The effectiveness of giving remission to special prisoners based on Government Regulation No. 99 of 2012 has not run optimally since there are still obstacles, especially the coaching programs of Class II A Padang prison officers have not been fully accepted and can be fully implemented by prisoners.

Abstract

Regarding Mineral and Coal Mining, the mining permit area is regulated in Article158 of Act Number 4 of 2009. West Sumatera Province, with its rich natural resources,attracts every person and corporation to carry out mining activities in various ways anduses of equipment that is not only traditional but also modern equipment using heavyequipment. The one of the modes of mining committed to carry out mining, theinvestigation was carried out by the Special Criminal Investigation Directorate of the WestSumatra Regional Police.

Abstract

The Bukittinggi Regional Police PPA Satreskrim Unit has received the Policereport No: LP / 07 / A / I / 2018 / SPKT / Res-Bkt, dated January 8, 2018, concerningcases suspected of being criminal acts of Trafficking in Persons. Where there has been asuspicion of a criminal offense "Ordering to do or participate in economic and / or sexualexploitation and / or criminal acts of Trafficking in Persons, as referred to in Article 2Paragraph (1) of Act Number 21 of 2007 concerning Eradication of Crime in Traffickingin Persons. This research is a descriptive analytical study. As for the results of research inthe Application of Elements Article 2 Paragraph (1) of Law Number 21 of 2007 concerningCrime of Trafficking in Persons by Unit Investigators Unit of PPA Satreskrim Bukittinggican be seen from the facts of arrest, witness statements and statements of suspects andapplication of elements of Article that is. The obstacle encountered by Bukittinggi RegionalPolice PPA Satreskrim Unit investigators in investigating criminal acts of Trafficking inPersons is an internal factor originating from a lack of understanding of personnel orinvestigators in carrying out an investigation process of the TPPO Law, in not all TPPOLaw elements can be fulfilled.

Abstract

The Police is one of the law enforcement agencies that has the power, power andauthority to perform the Police Discretion in the use of firearms in arrest of the suspect asset forth in Article 18 paragraph (1) and paragraph (2) of Law Number 2 Year 2002regarding Police Republic of Indonesia. Discretion of the police in the use of firearms inarresting suspects is the most recent action taken to paralyze a suspect. The issuesdiscussed in this thesis are: 1) Is the basis of consideration of Polri members to conductpolice discretion in the use of firearms in arrest of suspect crime? 2) How is theimplementation of police discretion in the use of firearms in the arrest of suspectedcriminal offenses in Padang Police? 3) What is the form of supervision and accountabilityfor the use of firearms by members of the National Police in Padang Police?. Thisresearch is descriptive analysis that describes or describes and explains the object ofresearch in a complete, clear and objective manner that has to do with the problem. Theapproach method used in this research is the normative juridical approach as the mainand empirical juridical approach as supporting the main approach, while the type of dataused includes primary data and secondary data. From the results of research anddiscussion can be concluded that: first, the rationale juridical discretion of the policeagainst the Law No.2 of 2002 on the Police of the Republic of Indonesia and Perkap No.1Year 2009 on the Use of Police Violence Collapse. Secondly, the implementation of thePolice Discretion is conducted in a situation that is very necessary and helps to investigateand make efforts against the police.. Third, supervision and accountability of the policediscretion in Padang Polresta directly to the leader or supervisor of the privacy. Abstract

Crime of theft by violence resulting in loss of life is regulated in Article 365 of theCriminal Code, so to be able to qualify acts that can be categorized as criminal acts, theinvestigator must pay attention to important and meticulous elements so that they canfulfill the criminal elements . At the investigation of the crime of theft with violence whichresulted in the loss of the lives of two members of the West Sumatra Regional PoliceMobile Brigade, Satreskrim Dharmasraya District Police conducted an investigation andapplied elements of Article 365 of the Criminal Code based on the construction of factsand construction of juridism so that the case files were declared complete and couldproceed to the narrative process .

Abstract

Sexual violence against children by children set on Article 76D and 76E of LawNo. 35 of 2014 Amending Law on Child Protection (No. 23/2002). Thedevelopment of social media has positive and negative effects. The negative effectschange culture, morality, and society value in general and increase number ofcrime by children specially. From the research results obtain several conclusions:First, the effects of social media on sexual violence against children by children inPadang City is about 82 percent. Through social media, children can accesspornography easily by facebook, whatsapp, twitter, instagram and etc. Somecases happen after children watching video by link in the social media. Second,Padang Police Resort’s effort to solve sexual violence against children bychildren cases caused by social media through three steps: preemptive, preventiveand repressive. The preemptive step is the first step by police to prevent a crime.The preventive step is special activities to eradicate the factors of violation bychildren, such as pornography access. The last, the repressive step handling byCrime Investigation Unit to investigate until deliver the case sheaf to prosecutor.

Abstract

Immigration investigations are carried out by the Immigration Officer as regulatedin Article 74 of Law Number 6 of 2011 concerning Immigration. The current globaldevelopments have pushed the mobility of the world population from one country toanother, which can have a positive and negative impact. In reality there are still manyimmigration violations committed by foreigners visiting the country of Indonesia. Based onthe results of the study concluded: First that the implementation of the role of theImmigration Division of the Regional Office of the Ministry of Justice and Human Rightsof West Sumatra in the investigation of immigration crimes is still less than optimal interms of prosecution and immigration control. Secondly, the obstacles encountered in theinvestigation of immigration crimes were due to the lack of quality and quantity of humanresources in immigration PPNS, inadequate allocation of funds and operational facilities,lack of community awareness about the presence and activities of foreigners around themand difficulties in collecting evidence and witnesses. Third, efforts to overcome obstaclesto investigating immigration crimes are carried out by improving the quality and quantityof immigration PPNS human resources by providing regular training, providing foreignlanguage courses, disseminating immigration laws, further improving coordinationbetween relevant agencies, especially the police and prosecutors, as well as increasingsupervision of foreigners who come out, enter and carry out activities in the territory ofIndonesia.

Abstract

The writing of this scientific paper discusses the legal protection of TraditionalRetail Business Actors Against the Development of Modern Ritek in Padang City. Thebackground of this scientific work is the number of modern retail minimarkets as well asshopping centers that stand in line with the development of the city of Padang, withoutaccompanied by a clear regulation in accordance with what has been mandated by thelegislation in force. What causes traditional retailers to gain competition and theconversion of traditional retail customers to modern retailers. The aim of this scientificwork is to find out about the protection of legal protection for traditional retailers againstthe development of modern retail in the city of Padang. This scientific work usingdescriptive analysis methods that can be drawn conclusions are: Presidential RegulationNo. 112 of 2007 concerning the Arrangement and Guidance of Traditional Markets,Shopping Centers and Modern Shops and Regulation of the Minister of Trade No. 70 / MDAG / PER / 12/2013 concerning Structuring Guidelines Traditional Markets, ShoppingCenters and Modern Stores have provided legal protection to traditional retailers,mandating regional orders to refer to regional regulations on zoning in the establishmentof modern retail and traditional markets. But in fact the city government of Padang doesnot have regulations regarding the zoning.
